Important: Not for Emergencies or Crisis Use

Talking Distance is not an emergency service. If you are experiencing a crisis or medical emergency, do not use Talking Distance. Instead, call your local emergency number (for example, 911 in the US, 112 in the EU, or your country’s emergency line) or seek immediate in-person assistance from emergency services. Talking Distance professionals cannot provide urgent or emergency help.

1. Introduction

Welcome to Talking Distance, a project of RMA Mental Health School LLP (hereinafter, “Talking Distance,” “We,” “Us,” or “Our”), based in Pune, India. By accessing or using our website, mobile applications, and other online platforms (collectively, the “Services”), you agree to comply with and be bound by these Terms and Conditions (the “Agreement” or “Contract”)

    • Non-Therapy Services: Blogs, non-diagnostic self-assessments, policy briefs, and a moderated online community.
    • Social Impact Initiatives: Free courses addressing critical social and mental health issues.

By using our Services, you signify that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy and any other relevant policies or agreements that may apply.

2. Scope of Services

Online Therapy Services

    • Services focused on personal and professional mental health development.
    • Not a substitute for professional medical advice, diagnosis, or treatment.
    • We do not provide treatment or diagnosis services.

Educational Courses

    • Offered in guided and unguided formats.
    • All courses are currently free as part of our social impact initiative.
    • Topics range from sensitive issues (e.g., self-harm, suicide ideation, menstrual health) to more general concerns (e.g., corporate stress).

Non-Therapy Services

    • Include blogs, non-diagnostic self-assessments, and policy briefs.
    • Strictly for educational and informational purposes.

Online Community

    • Access is restricted to registered members.
    • Must adhere to community guidelines for respectful engagement.

Description of Services

Talking Distance provides online mental health support services to clients globally. Our platform enables you to communicate with mental health professionals via secure video calls, voice calls, or messaging (depending on the service options we offer).

Important Regional Distinctions:

    • In regions where we have registered psychologists, we may offer therapy services within the scope of practice permitted in those regions.
    • In other regions, including India, we provide personal mental health counselling sessions focused on wellbeing support, skill-building, and personal growth rather than clinical therapy.

We do not provide medical advice, or prescribe medication. Always consult a doctor or qualified health professional for medical issues or advice on any medications or treatments.

Talking Distance is an international service – by using our platform, you understand that our professionals may have different qualifications depending on your location. Our professionals will practice in accordance with applicable regulations and ethical standards for their qualification level and region.

3. Eligibility and Access

Age Restrictions

    • No content is intended for users under 13.
    • Users aged 13–18 must have parental or guardian consent.
    • Parents/legal guardians must give explicit consent before minors can access Services.

Use of Therapy Services

    • You may need to set up an account with third-party audio-video service providers.
    • You may be required to provide Informed Consent and Emergency Contact Details.
    • If aged 13–18, parental or guardian consent is mandatory.

Institutional Use

    • Enterprises, schools, universities, or other institutions may customize or integrate Talking Distance Services.
    • Their terms and privacy policies also apply.

License to Use

    • Granted a non-exclusive, limited, non-transferable license for personal use only.
    • Talking Distance reserves all rights not expressly granted.

Compliance with Local Laws

    • Users are responsible for ensuring their usage complies with the laws of their jurisdiction, including mental health, data protection, and online content regulations.
    • Talking Distance adheres to GDPR (EU), HIPAA (US), PIPEDA (Canada), and other relevant regional data protection laws.

4. Payment and Cancellation Policies

Course Access

All courses are currently free of charge.

Coaching and Therapy Cancellation

    • Individual Sessions:
      • No fee if cancelled ≥24 hours before the scheduled session.
      • 50% fee if cancelled between 12-24 hours before the session.
      • 100% fee if cancelled less than 12 hours before the session or for no-shows.
    • Group Sessions:
      • No refunds due to reserved nature of group spots.
    • Processing Time: Once approved, refunds are processed to original account within 20 working days in India, longer (no more than 90 days) in case of international refunds.

Payment Methods

    • Payments are made via third-party payment processors.
    • Talking Distance does not store your payment details.

5. User Obligations

By using Talking Distance, you agree to:

Provide Accurate Information

    • Maintain the accuracy and completeness of your registration details.

Comply with Laws

    • Adhere to all applicable local, state, national, and international laws.

Secure Your Account

    • Keep your login credentials confidential.
    • Notify us immediately of any unauthorized account usage.

Engage Respectfully

    • No form of harassment, hate speech, or disruptive behavior.

Use Content Appropriately

    • Content is for personal, non-commercial use unless expressly permitted.

Obtain Parental Consent (if 13–18)

    • Parental or guardian consent is mandatory for minors.

6. Platform Usage

Acceptable Use

    • Use the platform lawfully and without infringing on others’ rights.

Prohibited Activities

    • Uploading offensive or illegal material.
    • Attempting to compromise platform security.
    • Impersonating any person or entity.

Content Guidelines

    • We reserve the right to remove content violating community standards or deemed inappropriate.

7. Intellectual Property

    • Talking Distance retains all rights to the content and IP on the platform.

User-Generated Content

    • By submitting content, you grant Talking Distance a worldwide, non-exclusive license to use, reproduce, and distribute your content.

Limitation of Liability

    • To the fullest extent permitted by law, Talking Distance is not liable for indirect, incidental, or consequential damages arising from your use of the Services.

Third-Party Services

    • We partner with third-party providers for payments, data storage, etc. While we ensure compliance standards, we are not responsible for their actions or omissions.

Non-Replacement of Professional Advice

    • Tools, courses, and content are supplements to professional help, not replacements.

Pre-Existing Conditions

    • Users with medical conditions (e.g., epilepsy, pregnancy, severe mental health issues) should consult healthcare professionals before using our Services.

9. Research and Data Usage

    • Fees paid prior to termination are non-refundable unless specified in the Cancellation Policy.

Termination by Talking Distance

    • We may suspend or terminate access for violation of these Terms or any suspicious/illegal activity.

Effect of Termination

    • Rights granted under these Terms cease immediately upon termination.
    • We are not liable for any termination of your account or Services.

13. Third-Party Links and Services

External Links

    • We are not responsible for the content or privacy practices of third-party websites.

Third-Party Service Providers

    • We work with various service providers to deliver our Services.
    • Their terms and privacy policies may also apply.

14. User-Generated Content

Submission of Content

    • Grants us the right to use, reproduce, modify, and distribute your content.

Content Standards

    • Must comply with platform guidelines. Inappropriate or illegal content may be removed.

15. Indemnification

You agree to indemnify and hold harmless Talking Distance, its affiliates, and staff from any claims, liabilities, or expenses arising from your use of the Services or violation of these Terms.

16. Force Majeure

Talking Distance is not liable for any delay or failure to perform obligations where such failure is due to events beyond our reasonable control (e.g., natural disasters, governmental actions, war, etc.).

17. Governing Law and Dispute Resolution

Governing Law

    • This Agreement is governed by the laws of Pune, India, without regard to conflict of law principles.

Dispute Resolution

    • Parties shall attempt amicable resolution within 30 days of a dispute.
    • If unresolved, disputes are subject to binding arbitration in Pune, India, under the Arbitration and Conciliation Act, 1996.
    • Arbitration will be conducted in English.

Cross-Border Disputes

    • If you are located outside India, this clause applies to the extent it does not conflict with applicable consumer protection or data protection laws in your jurisdiction.

18. Modifications to Terms

Right to Modify

    • We may update these Terms at any time. Changes become effective upon posting.

Notification of Changes

    • Material changes will be communicated via email or a prominent notice on our platform.

Continued Use

    • Continued use after updates constitutes acceptance of the revised Terms.

19. Entire Agreement

These Terms, along with any other legal notices and agreements (including the Privacy Policy) on the platform, constitute the entire agreement between you and Talking Distance regarding the Services.

If any provision of these Terms is found invalid, the remainder continues in full force, with necessary modifications made to preserve the original intent.

No waiver of any provision will be effective unless in writing. Failure to enforce a provision is not a waiver of that provision.

22. Academic Integrity and Use of Course Materials

Use of Course Materials

    • Limited to personal, educational use. No commercial redistribution or modification without written consent.

Plagiarism and Misconduct

    • We reserve the right to suspend or terminate accounts for academic dishonesty.

Certification and Completion

    • Certificates may be issued upon meeting course requirements. No guarantee of external accreditation or licensure.

Technical Support

    • Provided via email. We are not liable for service disruptions due to maintenance or technical failures.
